Джерела кооперативного права України: поняття, види та загальна характеристика

Abstract

This paper formulates the definition of a term "a source of law" and gives characteristics of the main sources of cooperative law. It was proved that the basic source of cooperative legislation is the Law of Ukraine "On Cooperation"; it was stressed that formation and activity of certain types of cooperatives is regulated by special laws of Ukraine, which have the priority of application, in particular: formation and activity of production cooperatives is regulated by Economic code of Ukraine; agricultural cooperatives fall under regulation of the Law of Ukraine "On agricultural cooperation"; formation and activity of consumer societies is regulated by the Law of Ukraine "On consumer cooperation"; credit unions are subjected to regulation of the Law of Ukraine "On credit unions"; formation and activity of cooperative banks is regulated by the Law of Ukraine "On banks and banking activity". The author proved the fact that cooperative law of Ukraine has complex character and belongs to sub-branches of economic law.
