Співвідношення понять «правовий статус» та «правосуб’єктність» атомних електричних станцій України та Енергоатому

Abstract

Стаття присвячена дослідженню теоретичного визначення таких понять, як «правовий статус» та «правосуб’єктність» атомних електричних станцій України та державного підприємства «НАЕК «Енергоатом», для того щоб зрозуміти, як ці два поняття взаємопов’язані, а також якими внутрішньогосподарськими зв’язками пов’язані між собою атомні електричні станції та державне підприємство «Національна атомна енергогенеруюча компанія «Енергоатом». Також досліджені підходи до цих понять різних учених-правознавців, зроблені висновки про правовий статус атомних електричних станцій України та державного підприємства «НАЕК «Енергоатом».

The article investigates theoretical definition of concepts such as «legal status» and « legal personality» nuclear power plants in Ukraine and the State Enterprise «of» Energoatom «in order to understand how these two concepts are interrelated internal economic relations. Ukraine nuclear power plants are separate units of the state enterprise «National Nuclear Energy Generating Company» Energoatom «.Legal status – it is a complex concept for the structure in which no single legal literature established opinions. Under the legal status (from the Latin word «status», which literally means «position», «state») usually refers to a set of rights and obligations of individual and legal persons. In legal theory this category fully investigated concerning the legal status of a person, an individual. The most common here is the definition of the legal status of a statutory system and state-guaranteed rights, freedoms and lawful interests of individuals and obligations. The legal status of participants in economic relations associated with legal personality, property that is to be the subject of commercial law, the bearer of subjective legal rights and obligations, take responsibility for their inadequate performance and be able to protect them from possible attacks, but does not match it. The concept of «legal status» in its broader meaning than « legal personality», which is its foundation. The article investigated the legal status and Energoatom nuclear power stations as well as the conclusions that the concept of «legal status», in addition to its rights and obligations are questions of formation and termination of the subject, the conditions of its organization and activities, the legal question forms management, structure, property base, and other responsibilities that characterize the position of the subject in the economic relations. The author draws conclusions that are part of the economic competence of the legal status of the entity and that the legal status of nuclear power plants is much narrower than the legal status of state enterprise «National Nuclear Energy Generating Company Energoatom.
