dc.description.abstractalt1	The article is devoted to the study of the criteria for determining the amount of monetary compensation (moral damage) and the possibility of its use in case of violation of copyright and related rights. The problem of determining the amount of non-pecuniary damage begins with the moment when the victim decides to sue the claim and should indicate the amount of compensation for moral damage and, even more, prove its amount. The absence of any system for determining the amount of compensation for suffering cause difficulties even among judges when deciding on the amount of monetary compensation. It is established that in violation of copyright and related rights the most important role is played by the following: the nature of the offense, the depth and duration of emotional suffering, the severity of forced life changes, the degree of decline in prestige, the state of health of the victim, and others. The analysis of court decisions on cases of non-pecuniary damage for violation of copyright and related rights made it possible to state that, among other criteria, when determining the amount of monetary compensation, judges often retreat from the depth of suffering of the victim. According to this, the depth of mental suffering is proposed to be divided into low, medium and severe. For a low level of emotional suffering, which is characterized by mild experiences, short-term mood changes that do not cause significant discomfort to the victim, do not affect his daily life. Mental suffering of moderate severity imply longer mental and emotional changes in the human body that manifest in the form of excessive annoyance, anxiety, persistent feelings, self-esteem, frustration in their activities, etc. Severe mental suffering is characterized by profound feelings, injuring the human psyche and causing accompanying functional disorders, sleep disturbances, appetite, loss of meaning in life, etc.	en_US
