У статті досліджено питання сутності конституційно-правового статусу глави держави в двох провідних країнах світу з різною формою правління: США (президентська республіка) та Німеччині (парламентська республіка).
Проведено порівняльний аналіз конституційно-правового статсусу глави держави. Зазначено, що конституційний досвід США є унікальним.
Актуальність теми дослідження зумовлена тим, що починаючи з ХVIIІ ст. у Конституції США були закріплені повноваження глави держави, які протягом століть залишилися незмінними. І цей досвід є надзвичайно корисним для України, яка з часу прийняття Конституції знаходиться в перманентному пошуку оптимальної форми правління і відповідно розподілу повноважень між гілками влади.
Встановлено, що незважаючи на ідентичну форму державного устрою та форму державного режиму в обох державах існує суттєва відмінність конституційних прав, наданих главам держав у президентській та парламентській республіках. Існує істотна відмінність між повноваженнями президентів США та Німеччини.
У статті ставиться за мету дослідити основні аспекти конституційно-правового статусу глав держав США та Німеччини.
З’ясовано, що сфера визначених Основним законом обов’язків глави США фактично ширша ніж глави держави Німеччини. Обґрунтовано необхідність розмежування повноважень, що дає змогу зрозуміти роль діяльності глави держави у виконавчій, законодавчій та судовій владі. Визначені існуючі обмеження та привілеї статусу глави держави надані Конституціями. Шляхом документального аналізу були визначені цензи, необхідні для висунення кандидатури на посаду президента. Зокрема, віковий ценз, громадянство, ценз осілості та інші особливі вимоги до кандидата.
У результаті дослідження автори доходять до висновку, що Президент США, відповідно до Конституції, здійснює повноваження не тільки глави держави, а і глави виконавчої влади. Глава держави Німеччини не має компетенції у сфері виконавчої чи законодавчої влади. В ієрархії органів влади ФРН він стоїть на другому місті після Канцлера. Спільним у повноваженнях двох глав держав є здійснення права помилування, призначення на посади суддів та чиновників, деякі повноваження президента США також здійснюються за порадою та згодою Сенату, як і в ФРН з Федеральним канцлером чи Федеральним міністром. |

The article examines the issue of the essence of the constitutional and legal
status of the head of state in two leading countries of the world with different
forms of government: the USA (presidential republic) and Germany (parliamentary
republic). A comparative analysis of the constitutional and legal status of the head
of state was carried out. It is noted that the constitutional experience of the USA is
unique.
The relevance of the research topic is determined by the fact that starting from
the 18th century, the powers of the head of state were enshrined in the US Constitution,
which remained unchanged for centuries. And this experience is extremely useful for
Ukraine, which since the adoption of the Constitution has been in a permanent search
for the optimal form of government and, accordingly, the distribution of powers
between the branches of government.
It was established that despite the identical form of state organization and form
of state regime in both states, there is a significant difference in the constitutional
rights granted to heads of state in presidential and parliamentary republics. There is
a significant difference between the powers of the US and German presidents.
The article aims to investigate the main aspects of the constitutional and legal
status of the heads of state of the USA and Germany.
It has been found that the scope of duties of the US president defined by the Basic
Law is actually wider than that of the head of state of Germany. The necessity
of separation of powers is substantiated, which makes it possible to understand
the role of the head of state in the executive, legislative and judicial powers. The
existing restrictions and privileges of the status of the head of state are provided
by the Constitution. Through a documentary analysis, the criteria necessary for
nomination for the post of the president were determined. In particular, the age
qualification, citizenship, residence qualification, and other special requirements for
the candidate.
As a result of the research, the authors come to the conclusion that the President
of the United States, in accordance with the Constitution, exercises the powers
of not only the head of state but also the head of executive power. The head of state
of Germany has no competence in the field of an executive or legislative power. In
the hierarchy of authorities of the Federal Republic of Germany, he ranks second
after the Chancellor. Common in the powers of the two heads of state is the exercise
of the right of pardon, and the appointment of judges and officials, some powers
of the US president are also exercised with the advice and consent of the Senate, as
in Germany with the Federal Chancellor or the Federal Minister. |
